Our commercial 30-day return guarantee

Independently of your statutory right of withdrawal, you can return any print within 30 days of receipt, without giving a reason, and receive a full refund of its purchase price. This commercial guarantee is described in detail in our General terms and conditions of sale (article “Commercial 30-day return guarantee”) and in the Commercial guarantee contract. It is in addition to your statutory right of withdrawal and the legal guarantees, and does not limit them.

During the statutory withdrawal period of 14 days, the rules of the withdrawal information below apply.

Information on exercising the right of withdrawal

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform us (Executionists, trading as “Mie Gallery”, 12773 Caswell Avenue, #104, Los Angeles, CA 90066, USA, phone +1 310 435 7452, email info@miegallery.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.

You can also exercise your right of withdrawal online at the “Withdraw from contract” link at the bottom of every page of our shop. If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by email), including its content and the date and time of its submission, without undue delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to Executionists, “Mie Gallery”, 12773 Caswell Avenue, #104, Los Angeles, CA 90066, USA, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

How to return a print

Please pack the print the way you received it: flat, between stiff board and in acid-free paper. Before sending it back, please send us a short note at info@miegallery.com if possible, so that we can make the return easier for you. This note is not a condition for a valid withdrawal.

You bear the cost of the return shipment, whether you exercise your right of withdrawal or our commercial guarantee. If the print arrived damaged or does not match its description, we bear the cost of the return shipment; your rights under the legal guarantees remain unchanged.

Import charges on returns

The import VAT, any customs duty, the handling fee and the carrier's fees paid on delivery were not paid to us: they were collected by customs or by the carrier. If you withdraw or return a print under our commercial guarantee, our refund therefore does not include them. This does not limit your statutory rights, in particular any right to compensation for loss in the event of a failure on our part.

Returning the print does not automatically lead to a refund of the amounts paid on import. The flat-rate duty of 3 EUR is not refundable on a simple return, except in the cases provided for in Article 116 of the Union Customs Code. You may apply to the carrier or to customs for repayment of the import VAT and, where applicable, of customs duty; approval is not guaranteed. Contact them before you send the print back and keep all supporting documents (customs declaration and proof of payment, proof of return shipment, proof of our refund). The European Union handling fee and the carrier's fees are not refundable. We will gladly provide you with a confirmation of the return and of our refund for any application.
