General terms and conditions of sale
This page is also available in French: Conditions générales de vente.
Last updated: 7 November 2026
Article 1 – Seller
These general terms and conditions of sale apply to sales concluded on miegallery.com/fr-fr and miegallery.com/en-fr between Executionists, trading under the business name “Mie Gallery”, 12773 Caswell Avenue, #104, Los Angeles, CA 90066, USA, email info@miegallery.com, phone +1 310 435 7452 (“we”), and any consumer who buys a print for delivery in France (“you”). Our full details are in the Legal notice.
Unique identifier (packaging, Article L541-10-13 of the French Environmental Code): being issued; it will be published here once received.
Article 2 – Prints
We sell Japanese prints, most of them antique. Each print is unique in its state of preservation: its date, the nature of the impression, its dimensions and its condition are stated in its description, with photographs. Antique prints are second-hand goods. The condition of each print, in particular signs of age and any defects, is described on its listing. The legal guarantees remain applicable. Where a characteristic departs from the legal conformity criteria, this departure can only be relied on against you under the conditions of Article L217-5 III of the French Consumer Code.
Article 3 – Prices
Prices are stated in euros. We do not charge French VAT, because the prints are imported from the United States. Delivery costs are added to the price and are shown to you before you confirm the order.
Import charges are added to the amount paid to Mie Gallery: import VAT, any customs duty, the European Union handling fee (from 1 November 2026) and the carrier's customs clearance fees. They are payable by you and are collected by the carrier, not by us. How they are calculated, the rates and examples are on the page Shipping and payment. The carrier's fees cannot be calculated in advance and may be payable.
Article 4 – Order
- You add one or more prints to your cart.
- In the cart, you click “Check out”.
- At checkout, you enter your email address and delivery address, and choose the delivery method and means of payment.
- Before confirming your order, you see a summary of all prints, the total price, the delivery costs and your details.
- By clicking the button “Order with obligation to pay”, you place a firm order that obliges you to pay.
- We acknowledge receipt of your order without delay by email. The contract is concluded when this order confirmation is sent.
The presentation of the prints on our site is not yet a firm offer. As each print exists only once, an order can only be confirmed if the print is still available.
Correcting input errors. Until you click the order button, you can check and change your details at any time: in the cart you can remove prints; at checkout you can correct your address, delivery method and means of payment at each step, by going back to the previous steps with the links on the checkout page or your browser's “back” function.
Language. You may conclude the contract in French or English. These terms are available in both languages (miegallery.com/fr-fr and miegallery.com/en-fr); if the versions differ, the version more favourable to you applies. Your mandatory consumer rights remain unaffected.
Archiving. We keep your order. With the order confirmation you receive by email these general terms and conditions of sale, the withdrawal information with the model form and the commercial guarantee document. If you have created a customer account, you can view your orders there at any time. For any order of 120 euros or more, we keep the written record of the contract for ten years from delivery and give you access to it at any time on request to info@miegallery.com.
Codes of conduct. We have not subscribed to any code of conduct.
Article 5 – Payment
You pay when you order. Payment is processed by Shopify Payments. The accepted means of payment are shown on the page Shipping and payment and from the start of the ordering process.
Article 6 – Delivery
We deliver to metropolitan France, from Los Angeles, by UPS or USPS. Delivery times for each delivery method are on the page Shipping and payment. We undertake to deliver within the time stated for the delivery method chosen before you confirm your order. This period runs from the order and includes preparing the shipment. Every shipment is insured and has a tracking number.
The risk of loss of or damage to the print passes to you when you, or a third party indicated by you, take physical possession of it. If your print arrives damaged, contact us: we arrange its return at no cost to you and refund the amounts paid to Mie Gallery for the print and its delivery, without prejudice to your rights under the legal guarantees.
In the event of delay, you have the rights provided in Articles L216-6 et seq. of the French Consumer Code.
Article 7 – Right of withdrawal
You have a right of withdrawal of fourteen days from receipt of the print. Its conditions, its effects and the model withdrawal form are on the page Withdrawal and returns. You can also exercise it online using the “Withdraw from contract” function at the bottom of every page of our site.
Article 8 – Legal guarantees
We are liable for lack of conformity of the print under Articles L217-1 et seq. of the French Consumer Code, and for hidden defects under Articles 1641 et seq. of the French Civil Code.
English translation of the statutory French notice (annex to Article D211-2 of the French Consumer Code), available in French on miegallery.com/fr-fr. Your statutory rights remain unaffected.
The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the intended period of supply. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity entails an obligation for the trader, where applicable, to supply all updates necessary to maintain the conformity of the goods.
The legal guarantee of conformity gives the consumer the right to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience to the consumer.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction of the purchase price by keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:
1° The trader refuses to repair or replace the goods;
2° The repair or replacement of the goods takes place after a period of thirty days;
3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a reduction of the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to request repair or replacement of the goods first.
The consumer is not entitled to termination of the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until delivery of the repaired goods.
The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who in bad faith obstructs the implementation of the legal guarantee of conformity incurs a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from discovery of the defect. This guarantee gives entitlement to a price reduction if the goods are kept or to a full refund against return of the goods.
Second-hand goods. Antique prints are second-hand goods. For these goods, the period during which a lack of conformity that appears is presumed to have existed at delivery is twelve months (Article L217-7 of the French Consumer Code). The two-year period of the legal guarantee of conformity is unchanged.
To use a legal guarantee, write to us at info@miegallery.com. Because a print is unique, replacement may be impossible. Your rights to repair, replacement, price reduction or termination of the contract remain subject to the conditions of Articles L217-8 to L217-14 of the French Consumer Code. Any refusal to bring the goods into conformity is reasoned in writing or on another durable medium.
Article 9 – Commercial 30-day return guarantee
In addition to your statutory rights, we offer you a free commercial guarantee: you can return any print within 30 days of receipt, without giving a reason, and receive a full refund of its purchase price. You bear the cost of the return shipment, unless the print arrived damaged or does not match its description. The content, duration, territorial scope, how to use it and the exclusions of this guarantee are in the Commercial guarantee contract, which is also provided to you on a durable medium with the order confirmation. This guarantee applies without prejudice to your right of withdrawal, the legal guarantee of conformity (Articles L217-1 to L217-32 of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code).
Article 10 – Complaints and mediation
For any complaint, write to us at info@miegallery.com or to the postal address in Article 1. Mie Gallery is established in the United States and has not appointed a consumer mediator. We will consider any proposal for an amicable settlement, including mediation, that you submit to us.
Article 11 – Personal data
We process your personal data in accordance with our Privacy policy.
Article 12 – Applicable law
These general terms and conditions of sale are governed by French law. You may bring proceedings before the competent court of your place of residence.
